What Is Criminal Compliance?
Criminal compliance refers to a set of procedures and best practices designed to prevent, detect, and manage criminal risks within a company. Its main goal is to prevent the company or its managers from being held liable for criminal offenses such as money laundering, corruption, fraud, or tax-related crimes.
Since the reform of the Spanish Criminal Code in 2010, legal entities can be held criminally liable. In particular, Article 31 bis of the Criminal Code states that companies can be exempt from criminal liability if they have an effective organizational and management model in place to prevent crimes.
Is Criminal Compliance Mandatory for All Companies?

Large companies and those operating in regulated sectors are subject to greater compliance obligations.
